Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you (the "User") and NEPCONN Pvt. Ltd. ("NEPCONN", "we", "our", or "us"), a company headquartered in Kathmandu, Nepal. These Terms govern your use of the NEPCONN mobile application, website, and services (collectively, the "Platform"). By registering with, accessing, or using NEPCONN, you affirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease using the Platform.

Scope of Services

NEPCONN provides a technology-driven platform to facilitate ride-sharing and vehicle rental services. Our services include connecting passengers with vehicle owners, agencies, and freelance drivers offering rides in cars, jeeps, hiace vans, and other registered vehicles. NEPCONN itself does not own, operate, or manage any transportation vehicles and does not act as a transportation provider. All transportation services are provided by independent third parties who are not employees or agents of NEPCONN. NEPCONN serves solely as a facilitator and assumes no responsibility or liability for the transportation services rendered by these providers.

Eligibility and User Obligations

To be eligible to use NEPCONN, you must be at least 18 years old and capable of entering into legally binding contracts under the laws of Nepal. If you are a transportation provider, you must possess a valid driver’s license, proof of vehicle ownership or legal right to operate, and necessary permits and insurance coverage required by applicable laws. NEPCONN may require identity verification documents, including but not limited to a national ID, driver’s license, and proof of address. Users must ensure the accuracy of all information provided and keep their profile updated.

Driver and Passenger Responsibilities

Drivers and vehicle owners are required to maintain their vehicles in a roadworthy, safe, and clean condition. They must ensure all legal documents, including registration and insurance, are valid and current. All bookings must be conducted via the NEPCONN Platform, and any off-platform agreements for rides or pricing are strictly prohibited. Passengers are expected to respect booking times, communicate changes promptly, and complete payment as agreed. Misconduct, late cancellations, and misuse of services may result in account suspension or termination.

Booking, Payments, and Pricing

All ride bookings must be made through the NEPCONN application or website. NEPCONN charges a Service Fee, which may be a fixed amount or a percentage of the ride fare, and this fee is non-refundable. Drivers must submit this Service Fee once their earnings reach a specified threshold. Payments can be made in cash or, where applicable, through NEPCONN Credits, which are pre-paid funds stored within the app. In case of discrepancies in pricing due to significant deviations from estimated distance or time, NEPCONN reserves the right to adjust fares at its sole discretion.

Cancellations and Refunds

Cancellations must be communicated as early as possible. NEPCONN reserves the right to impose penalties or restrict account access in case of habitual cancellations, no-shows, or breaches of conduct. In certain cases, refunds may be applicable based on predefined criteria. NEPCONN will not be responsible for collecting or resolving payment disputes outside the Platform.

Code of Conduct

All users are required to follow NEPCONN’s Code of Conduct, which mandates professional behavior, punctuality, non-discrimination, and responsible use of the Platform. Any form of harassment, intimidation, spamming, or off-platform solicitation is strictly prohibited. Transportation providers must not advertise or refer customers to competitors or third-party services.

Insurance and Liability

NEPCONN does not provide insurance coverage. Transportation providers must ensure their insurance includes coverage for passengers and complies with legal regulations. NEPCONN disclaims any liability for injuries, accidents, or losses incurred during a ride. Users participate in rides at their own risk and are encouraged to review their insurance policies prior to using the service.

Data Privacy and Security

By using NEPCONN, you consent to the collection and processing of your personal information in accordance with our Privacy Policy. NEPCONN may use your data to verify identity, detect fraud, process transactions, and improve service delivery. You may be required to verify your phone number, provide documents, or submit to background checks where permitted by law. NEPCONN ensures compliance with applicable data protection laws and takes reasonable measures to safeguard user information.

Platform License and Restrictions

Users are granted a limited, non-exclusive, non-transferable license to use the NEPCONN Platform for personal, non-commercial purposes. You may not modify, copy, distribute, reverse-engineer, or exploit the Platform or its contents. Any attempt to interfere with Platform operations, introduce malware, or engage in unauthorized data collection is grounds for legal action and immediate account termination.

Account Suspension and Blacklisting

NEPCONN reserves the right to suspend, block, or permanently terminate any account found violating these Terms. Reasons for suspension may include repeated complaints, unsafe driving, pricing manipulation, failure to remit service fees, or fraudulent activity. NEPCONN also reserves the right to withhold payments, impose fines, or refer matters to authorities if required.

Dispute Resolution

In the event of disputes between users (e.g., between passengers and drivers), NEPCONN may provide an informal resolution process. However, NEPCONN is not responsible for enforcing private agreements. For unresolved matters, jurisdiction lies with the courts of Kathmandu, Nepal. NEPCONN may also, at its discretion, refer disputes to third-party arbitration services.

Disclaimer of Warranties

NEPCONN disclaims all warranties, express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement. The Platform is provided "as is" and "as available." NEPCONN does not guarantee uninterrupted service, error-free functionality, or the accuracy of Platform content. Your use of NEPCONN is at your sole risk.

Limitation of Liability

To the fullest extent permitted by law, NEPCONN’s liability shall not exceed NPR 1,000 in any event. NEPCONN is not liable for indirect, incidental, or consequential damages arising out of or relating to the use of the Platform or services rendered by third parties.

Amendments and Updates

These Terms may be modified at any time. Users will be notified of changes through updates on the Platform or via email. Continued use after notification constitutes acceptance of the revised Terms. NEPCONN may also introduce new services, adjust features, or amend fees without prior notice.
